Terms and Conditions

All products are sold subject to English law and the terms and conditions set out below. Nothing mentioned in these conditions affects your English law statutory rights.

Cancellations and Returns

Products sold online may be returned and refunded to you for any reason provided the conditions below are followed.

When returning products sold online, please return them together with proof of purchase (a receipt or dispatch note).

All goods are checked and sent out in good saleable condition. Refunds will not be made if goods are not returned as such.

Once Products have been delivered, you may only return them within 14 days of receipt.

You may return any products sold online by courier at your own cost and risk. If the goods are not received back refund will not be given.

Please note that no liable will be accepted for any loss or damage to any returned products in transit and as such, it is recommended that you return any products through a recorded delivery service. When returning products, please package the products properly and securely together with the dispatch note to ensure that the products are not damaged during transit. Returns, Bradwell Art, 15 Queen Street, Leeds, LS2 8AJ. Please retain a certificate of posting from your post office as proof of postage.

Please allow up to 30 days for refund sums to credit your account due to third party systems involvement which adds to processing time.

Orders

As a small bespoke business stock supply of products might at times be limited. For instance, Bradwell Art cushions are handmade in small numbers. The website aims to keep stock levels up to date, but in the unlikely event stock levels are not updated and you place an order for an item which is out of stock and your payment has been processed in error, you will, of course, be refunded, with no additional liability to you.

As a working artist, there may be times when the processing of orders is on hold. Best endeavours will be used to continue the processing of orders as promptly as possible and contact you if the situation arises which might delay the processing of your order. Whilst it is hoped this does not occur, no liability is accepted arising from the late delivery to you.

It is your responsibility to ensure your order is entered correctly and there is access for delivery.

P.O. box numbers, hotels and temporary addresses are not permitted.

All goods are despatched suitably packaged for transit purposes only. If goods arrive damaged contact must be made to info@Bradwellart.co.uk  within 72hours.

We do not take responsibility for goods that have been damaged after delivery as a result of poor handling or storage.

We reserve the right to refuse supply of products or services to any individual or company.

Ownership

The Website is an official website of Bradwell Art and the copyright and the database rights are owned by such. The Website and all intellectual property rights (including but not limited to rights in the website as a database) in its text, design, graphics, and the selection, organisation and arrangement thereof, together with the Bradwell trademark and all other trademarks, logos and trade names depicted on the website belong to the proprietor.

Limited Licence and Restrictions

You agree that the material and content contained on the Website is for your personal and non-commercial use and that you may only download such material and content for the purpose of using the Website to a single personal computer. Furthermore, you acknowledge and agree that any other use of the material and content of the Website is strictly prohibited and you agree that it is strictly prohibited to (or to assist or facilitate any third party to) copy, reproduce, transmit, modify, publish, display, distribute, commercially exploit or create derivative works of material and/or content from the Website without our written permission and is a violation of our intellectual property rights.

Basis of a Sale

The following is required to create a contract between you and us:

You place the order for your products by pressing ” Checkout” on the “Review Your Order page”, and in doing so you offer to buy the goods at the prices indicated as well as any applicable delivery charges.

An order acknowledgement email will be sent to you detailing the products you have ordered. Please note that this email is merely an acknowledgement of your order and not an acceptance or confirmation of your order by Bradwell Art.

The acceptance of your order and the completion of the contract between you and us will take place on payment of the products unless we have notified you that we do not accept your order or you have cancelled it.

Except for the right of return for on line sales, these terms and conditions also apply to contracts entered other than through the online shop.

Once we have accepted your order and it is paid for in full it becomes binding, subject to your rights of cancellation. Non-acceptance of an order by us will occur if the ordered product/s is out of stock or unavailable if we identify a pricing or product description error or are unable to obtain authorisation for your payment.

We reserve the right to withdraw any products from this website at any time or remove or edit any information on our website. We will not be liable to you or any third party by reason of our removing any product from our website whether or not that product has been sold; removing or editing any materials or content on the Website, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

To be eligible to purchase products on this website you must be over 18 years of age, register by providing your real name, phone number, email address, payment details and other requested information also provide a valid delivery address and a valid credit or debit card issued by a bank acceptable to us.

Precise colour matching cannot be guaranteed between different printing runs.

Fabric

Fabrics have natural and manufacturing characteristics such as slubs and nap direction on velvet. When selecting a cushion you must be aware of its suitability for purpose and of its characteristics.

Fabrics and dyes can be affected by light, therefore we recommend that products where possible are positioned away from direct sunlight and heat to protect them from fading and premature wear.

Cushion care is dry clean only.

Every effort is made to display as accurately as possible the colours of our products that appear on our website.

However, due to variations in monitor display, it is not guaranteed the website displays of colours will be accurate.

Cushion fabric supplied is without any soil or flame retardant coatings

Velvet cushions will be printed with the nap going down (unless otherwise stated).

Bradwell Art cushions have feather filled pads. These will flatten with use. These should be plumped by hand often to restore the fullness.

Delivery

Once an order is placed it is the aim to be dispatched within 48hours excluding weekends and public holidays, unless the ‘lead time’ states otherwise. First class post is used for U.K. orders for cushions as it aims to deliver next day, although this is not guaranteed. If you wish to have next day or time is of the essence please contact info@Bradwellart.co.uk Prints are despatched and aimed to be delivered within 7 working days for U.K customers.  Cards are sent by second class post for U.K orders unless otherwise requested. We shall not be liable for delays and/or failures in delivery if we cannot gain access to the property. Additional charges may apply for the storage of the products if the customer delays delivery, for more than three weeks after the estimated date of arrival. Delivery dates are not guaranteed but we will do our utmost to ensure goods are delivered within the stated date or soon afterwards. If you have not received your order within 7 days from placing your order please contact our customer service team to investigate the non-arrival.

Risk of Damage in Transit

We carry the risk of loss or damage to the products until you receive them. The products belong to you when you have received them and have paid us in full. If you return the products to us for any reason, they will become our property and be at our risk from the time we receive them.

Product Use

Bradwell Art cushions are designed for interior use unless otherwise stated. It is the customer’s responsibility to ensure that the product is fit for purpose for the end use.

On fabric shade may vary slightly from one printing batch to another.

These may be more apparent if orders are placed at different times.

We reserve the right to make any change to the specifications of our products where necessary.

All sizes are approximate. No liability is accepted for variations.

Prices

Prices exclude delivery charges unless otherwise stated.

All prices are correct at time of publishing, but may change due to inadvertent administrative errors or circumstances beyond our control, such as future vat registration.

No responsibility is accepted for import duties or other local taxes for International shipments.

Payment Methods

You may pay using, PayPal, Visa, Visa Debit, Visa Electron, MasterCard and UK Maestro. American Express is not accepted. You confirm that the credit, debit or store card that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery. All card payments are processed for you by our credit card acquirers for a fee included in the cost of your purchase.

Reasonable precautions will be taken to keep the details of your order and payment secure, except where we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.

Reasonable care will be taken to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was uploaded onto the system. Although we aim to keep the content as up to date and accurate as possible, however due to inadvertent clerical or administrative errors the information including product descriptions appearing on this website at any particular time may not always reflect the product exactly. Please note that in the event that an error is identified non-acceptance of an order by us may occur, subject to your statutory rights.

We make no representations about any other websites which you may access through our website or which may link to our website. When you access any other website you understand that it is independent of us and that we have no control over the content or availability of that website. Privacy is respected for your personal data and compliance with all relevant and current data protection legislation.

If you wish to update or delete your personal information that has been specifically left on any mailing list, please contact us.

To proceed with your order, we have to process and store your data and provide your data to third parties who are directly involved with your order, e.g. our couriers. By placing an order with us, you agree to your data being processed by the proprietor. We will not pass on your data to anyone outside or organization.

Accordingly, when buying through our site, you can be sure that you are completely protected.

Risk and Title

No order is binding on you or Bradwell Art until we have accepted it. All title and ownership to the ordered products will pass to you from the moment they are dispatched by us to the postal service, or to our carriers, or on payment in full by you of the price of the Goods and any delivery charge (if applicable), and risk will pass on delivery.

If any provision contained in these terms and conditions is considered by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other terms and conditions which shall remain in full force and effect.

You may not assign or sub-contract any of your rights or obligations under these terms and conditions or any related order for products to any third party without our written consent. We reserve the right to transfer, assign or subcontract any of our rights or obligations under these terms and conditions or any related contract to any third party.

Waiver

A failure by us to exercise or enforce any right conferred upon us by these terms and conditions shall not be deemed to be a waiver of such right or operate so as to bar the exercise or enforcement thereof at any subsequent time or times.

The right to amend these terms and conditions at any time is reserved.
